The Federal Court of Appeal sitting in Kaduna has upheld the verdict of the Katsina State Tribunal that canceled the election of Federal House of Assembly member representing Mashi and Dutsi Federal Constituency.

The court in its ruling by the judge also ordered for a re-run of the election in 30 days.

It could be recalled that on 15th of November, 2017 the National and State Houses of Assembly Election Tribunal for Katsina state has nullified the election of Member representing Dutsi/Mashi federal constituency, Mansur Ali Mashi and ordered for a fresh election in 90 days.

Then, the Chairman of the tribunal LM Boufini in his judgement said the election was substantially marred with irregularities and non compliance with the electoral act.

In his ruling, Boufini explained that 15 polling units were greatly affected by the problem which should have change the tide of the election if their votes are well captured and articulated.

It could also be recalled that a bye election was held on May 20th, 2017 following the death of a member Sani Bello, where the APC candidate Mansur Mashi was declared winner.

The PDP and its candidate Nazifi Bello filled a petition before the tribunal challenging the return of Mashi on two grounds that Mansur was not duly elected by the majority of lawful votes cast.

They also alleged that the election was invalid by reason of non-compliance with the provision of the electoral act.
